ARC’s Equal Pay case closes
In 2012, on behalf of a number of its members, ARC launched an equal pay challenge. We have supported this case through the legal stages at the Employment Tribunal, Employment Appeal Tribunal and Court of Appeal. In July 2019, we lodged an appeal to the Supreme Court.
Unfortunately, we have now heard that the Supreme Court has refused permission to appeal. There is no requirement for the Supreme Court to give reasons for the decision to refuse permission to appeal, nor any right to review this application. We are also not able to progress this appeal any further e.g. European Court of Justice. Therefore this case and challenge has to now come to a close.
I want to express my thanks all those who have been involved, from the claimants who agreed to be part of this claim, the lawyers who have advised us at all steps along the way, and last but definitely not least, all the ARC representatives who have given countless hours over the years in assisting with this claim. I would also like to place on record a special mention and thanks for Helen-Baird Parker for all her help, support and dedication in assisting with this claim on behalf of members.
ARC will never shirk from bringing a claim when it is right to do so, and we will always continue to do that for members. We will always fight for our members’ interests. Whilst this claim has now come to an end, we will continue to push HMRC in addressing what we feel is an inequality in our pay system until that result is achieved for our members.
